Obligation to transfer
the condominium (flat) ownership If a flat owner violates the rights of other flat owners to the point behind endurance by not fulfilling the obligations and failing to pay the debts liable under the Flat Ownership Law, the other flat owners are entitled to ask the judge that the ownership right of the owner be transferred to them. Filing an action against such a flat owner for paying the value of property of independent division at the nearest date to the decision and transferring this ownership to other flat owners proportionally with their building plot shares is possible only if the other condominium owners make a decision by a majority, unless otherwise has been previously agreed. These are the circumstances such as to fail to pay the debts resulting from common expenses and advance payments requires executive processing or legal action three times in two calendar years and to use the independent unit as a house of prostitution, gaming house or the like.
